Municipal
Solid Waste:
All urban local bodies come under the purview of the
Municipal Solid Wastes (Management and Handling) Rules,
2000. The Board has identified 156 nos. of local bodies
under the purview of this Rule. Out this 75 are Urban
Local Government.
Authorization:

Every municipality is responsible to provide
facilities for collection, storage, segregation,
transportation, processing and disposal of
solid wastes. They are also required to obtain
Authorisation of the Board for operating these
facilities. |

The Department of Urban Development in the
State has overall responsibility for enforcement
of these rules in metropolitan cities. The
District Magistrates or the Deputy Commissioners
have the overall responsibility to enforce
the rules in their jurisdiction. |

On the urban local bodies and operators applying
for Authorisation for handling / processing
/ disposing solid wastes, the Board is to
issue/refuse Authorisation. The Board is to
monitor compliance with the conditions of
the Authorisation and to take appropriate
follow up action. |

How
to Obtain Authorization ?
The municipal authority or an operator of a facility
shall make an application in Form-I,
for grant of authorization for setting up waste processing
and disposal facility including landfills from the State
Board or the Committee in order to comply with the implementation
programme laid down in Schedule I. The Application for
Authorisation is available at all offices of the Board
or can be downloaded from the site, free of cost and
is to be submitted with prescribed fee as Demand Draft
in favour of the Member Secretary, Pollution Control
Board, Assam payable at Guwahati.
The municipal authority shall furnish its annual
report in Form-II
to the Secretary-incharge of the Department of Urban
Development of the concerned State in case of an metropolitan
city; or to the District Magistrate or the Deputy Commissioner
concerned in case of all other towns and cities, with
a copy to the State Board on or before the 30th day
of June every year. The State Board shall prepare and
submit to the Central Pollution Control Board an annual
report with regard to the implementation of these rules
by the 15th of September every year in Form-IV. The
Central Pollution Control Board shall prepare the consolidated
annual review report on management of municipal solid
wastes and forward it to the Central Government alongwith
its recommendations before the 15th December every year.
Implementation
of the Rules

P.C.B.A
has already categorised and quantified the
MSW generated in the city of Guwahati. |
| 2. |
All
the Municipal Authorities in the state are
directed to apply for grant of authorisation
and submit Annual Report. |
| 3. |
All
the 75 Nos. of Urban Local Government were
asked to comply with the rules as per provision
of the M.S.W (Management & Handling) rules
and submit report. |
| 4. |
All
the Deputy Commissioner of 23 districts in
the state were requested to enforce the provision
of M.S.W rule and accordingly District Magistrate,
Kamrup district vide their office order No.
KMJ, 3/2001/82 dtd. 21/9/2001 has passed the
prohibitory order U/S 144 CRPC 1973 for extensive
throwing of garbages/wastages haphazardly
in front of residential house, Restaurant,
Hotels, Nursing homes, business establishment
etc. |

Correspondence
made with Science, Technology & Environment
Department, Govt. of Assam from time to time
and a meeting was organised with Commissioner
-Secretary, Science, Technology & Environment
Department on 13th March 2001 in connection
with the implementation of the rule. |

A
separate cell has already been constituted
in the Board to look after the possible aspects
relating to management of the rule in the
state and also co-ordinated activities with
different Govt. organisation and U.L.B. |

A
workshop organised by Regional office, United
States-Asia Environmental Partnership (US-AEP)
on technical assistance for municipal solid
waste management plan on 8th & 9th October,
2001 was attended by Board's officials. |
